Parody’s protected under fair use law. That’s why Weird Al can’t be sued. He only asks for permission as a professional courtesy, not because he’s legally required to.

last i heard, it wasn’t illegal to make a parody without permission.
but like a 21344324 laws were made this year, so i don’t know.

i agree with ‘b hunt rip the rev’ … shes a stroppy teenager who has a rich daddy and wants more money for her minature dog and botox.
i hope she looses the case and i hope wierd al writes a song about how annoying she is.
even her cruddy brother tre can write songs better than her and i bet she didnt even write that stupid song anyway!

I love this. I think all along The Fold was just making a funny youtube, and someone else started the rumour that it was true. Either way, they made a great parody, their new album is EPIC ( http://www.thefoldrock.com/album and it’s only like $4 for all 11 songs PLUS “Every Band in the USA”) and this new video is cameo-fest 2010! Pete Wentz, Alex from All Time Low AND Tom from Plain White T’s. I’m in love with The Fold!

She has the right to Sue whoever makes a parody of one of her songs, but she doesn’t necessarily Need to. Look at VenitianPrincess …etc..there are many people on youtube who have made Parody’s of Party in the Usa. Using the same tune to a song is sometimes illegal, depending on if your writing a new song, but making a parody is not illegal unless the Singer/Song Writer says so. If Miley Wants to Sue the Fold for making a Parody than that’s up to her, but there is no need to Sue when she has never sued other Parody Makers of her. I Hope this helps x
